Milky Cat 2D — Terms of Use

1. About these terms

PERSOFTWARE SRL, Romania, provides Milky Cat 2D. For game, purchase or legal questions, contact persoftware.srl@gmail.com. These terms govern use of this game, not the separate original Milky Cat game. They describe core gameplay and optional features only where those features are actually offered. They do not promise a release date, a particular product catalogue or permanent availability.

Please read these terms before playing. If you cannot agree to them, do not use the game. Nothing here removes rights or remedies that applicable law does not allow us to exclude.

The explicit AGREE & CONTINUE action on the welcome screen records agreement to the displayed version of these Terms. Merely viewing a document, choosing an age group, scrolling or closing a notice does not agree to them. Until you select AGREE & CONTINUE, the Terms remain unaccepted and existing progress is preserved; you can review them or leave the game. Agreement to the Terms is not consent to optional analytics, tracking or any future service.

2. Age and permission

The intended audience is teens and adults. If you are not old enough to enter into this agreement under the law where you live, a parent or guardian must review it and authorize use where required. Store restrictions and parental controls continue to apply.

Our welcome screen asks a parent or legal guardian to review and agree for players who select an under-18 age group. For an undisclosed age, the person agreeing must be able to enter the agreement themselves or be the player's parent or legal guardian. These are declarations, not verified identity, proof of age or verified parental consent to personal-data processing. Features requiring additional safeguards remain unavailable until those safeguards exist.

Age-group selection is used for privacy protections. Selecting an age is not proof of age, parental authorization, contract acceptance or consent to optional data use. You may decline to share your age and still access core play. Optional online features may be restricted by age, region, permissions or store rules.

3. Your licence and fair play

Subject to these terms and applicable store rules, we grant you a limited, personal, non-exclusive, non-transferable licence to install and use the game for non-commercial entertainment on devices you are entitled to use. The game and its artwork, audio, code, characters and other content belong to us or our licensors; purchasing an item does not transfer ownership of those rights.

Do not infringe others' rights, distribute unauthorized copies, exploit purchase or reward systems, impersonate someone else, bypass security, or interfere with the game or its services. Restrictions on reverse engineering or modification apply only where legally permitted. Accessibility, research and other activities protected by applicable law are not prohibited merely by this clause.

4. Local progress, accounts and cloud saves

Progress always saves on the device. Eligible players who select age 13 or older can turn on Cloud Save where the feature is enabled after setup. Firebase creates an anonymous authenticated session without a Firebase login prompt. Our server verifies the current Google Play Games player on Android or Game Center player on iPhone and binds that platform identity to the Firebase Milky Cat 2D game account used for server backup and reinstall recovery. Optional Google or Apple Firebase sign-in can be linked for cross-platform restore. A platform provider may show its own account prompt; Milky Cat does not ask for a game password. Sign-in failure does not block local play. Uninstalling, clearing storage, replacing a device or a corrupted save can lose progress that has not reached a backup. Do not assume that an email address lets us recover a local save.

The backup includes the complete gameplay profile, including levels, Bottles, upgrades, inventory, nickname and reward records. Age, Terms and privacy choices stay on each device. If device and cloud saves differ, the game asks which complete save to keep. Offline uploads may be delayed. The same verified Play Games profile or Game Center player can restore its bound server save after reinstalling on that platform. A linked Google or Apple Firebase sign-in can restore its server save across Android and iPhone through a supported sign-in method. Separate, unlinked accounts have separate backups. Cross-store purchase transfer is not offered. Keep your platform account secure and report suspected unauthorized access.

Profile → Cloud Save → Remove Backup requests deletion of this game's backup from the connected service and stops future uploads on that device while keeping its local progress. If removal cannot be confirmed, retry later or contact support. Turning backup on later may upload the local copy again. When account-backed backup is active, Game Account → Delete Account removes the Firebase game account and its server save while retaining progress on this device. Neither control deletes your Google account, Apple ID, Play Games profile or independent store transaction history. Linking Google and Apple to one game account associates those sign-in identities with the same backup and requires an in-game confirmation.

5. Bottles, items and rewards

Bottles, upgrades, inventory, cosmetics and other virtual benefits are game features, not money, financial assets or gambling stakes. They cannot be cashed out or transferred outside the game. They may be earned or, only when expressly offered, acquired through the store. There are no paid randomized rewards or subscriptions in the planned initial catalogue.

Progression, quests, achievements and daily rewards may have clearly stated eligibility, claim windows and limits. The displayed offer controls what is granted. We may correct duplicate or fraudulent grants, with a support route for mistakes. Balance changes must respect applicable consumer rights and the terms on which paid content was supplied.

6. Advertising

On Android and iPhone, eligible players may be offered a Google AdMob rewarded ad that doubles the Bottles earned in the completed match. The normal match reward is granted first; the completed ad adds the same amount once. This does not double your whole balance or change the match result. Closing early, an unavailable ad or a failed ad does not remove the normal reward. A reward cannot be guaranteed if the app is interrupted before the provider confirms completion.

Occasional between-level interstitial ads may appear after a win when selecting Continue, with an introductory grace period and spacing between full-screen ads. Ads do not interrupt a match; an unavailable interstitial does not delay progression. Under-13 and undisclosed-age players receive no ads, and personalization is disabled for under-18 players. Advertising is unavailable in the browser version.

The Privacy Policy explains Google advertising data use and the separate privacy controls. Consent messages and platform tracking permissions apply where required; agreement to these Terms does not supply advertising or tracking consent. Refusing optional processing keeps core gameplay and normal rewards available. Ads and rewards depend on availability and provider confirmation, and are never a cash entitlement.

7. Optional purchases — when available

Purchases are not enabled in the current version. If offered, the purchase screen identifies the product, localized price, contents, restrictions and whether it is consumable or restorable before you confirm through Apple or Google. Obtain any required payer or guardian permission. Never send us payment-card credentials.

Consumables already spent generally cannot be restored as an unused balance merely by reinstalling. Eligible non-consumables can be restored using the relevant store account and the game's restore control. Cross-store transfer is not promised. Pending or deferred purchases are delivered only after store confirmation; cancelled or failed purchases do not grant a paid entitlement.

8. Refunds, restores and consumer rights

For payment disputes and refunds, use the purchase store's process; contact us for missing delivery or game-side support. Have the transaction reference available, but omit full payment details. A refunded or revoked transaction may remove the corresponding entitlement as permitted by law. We must not charge you again to restore a valid restorable purchase.

Mandatory remedies for faulty, misdescribed or undelivered digital content remain available. We do not impose a blanket “all sales final” rule. Where local law requires express consent to immediate digital delivery and acknowledgment of the effect on a withdrawal right, that must be obtained in the applicable purchase process; these terms alone are not that acknowledgment.

9. Privacy and optional choices

The Privacy Policy explains local data, support and the data needed by enabled services. Optional analytics, platform account use and any future tracking permission are separate choices. Reading a document or continuing to play does not consent to optional personal-data processing.

Settings → Privacy & legal contains the policy, these Terms, age review and privacy help. Refusing optional processing does not block core gameplay or invalidate paid entitlements.

10. Updates and service changes

We may update the game for security, compatibility, bug fixes, content or balance. Online features depend on networks and providers and can be interrupted. Install updates needed for safe, supported use.

Material changes to these Terms are identified by a new version and highlighted in-game; additional notice or agreement is obtained where required. We do not claim a right to apply new purchase terms retroactively or erase mandatory rights. If a paid service or item must be materially changed or discontinued, applicable notice, remedies and consumer protections apply.

11. Misuse and ending use

You may stop using the game at any time. When accounts or online services are offered, we may restrict access proportionately for serious misuse, security risks or legal requirements. Where appropriate and lawful, we explain the reason and provide a way to contact support to challenge a mistake. A good-faith privacy request, complaint or refusal of optional consent is not misuse.

Uninstalling does not automatically refund purchases. Clauses that by their nature need to survive termination, such as ownership and accrued payment or statutory rights, continue to apply.

12. Responsibility and disputes

We aim to provide a functioning game but cannot promise uninterrupted, error-free operation or compatibility with every device. We are responsible to the extent required by applicable law. We do not exclude liability that cannot legally be excluded, including applicable statutory guarantees, fraud, intentional misconduct or other protected claims. You retain mandatory local consumer remedies.

Romanian law applies only to the extent permitted, without taking away mandatory protections of your country of habitual residence or your right to use a competent court available under applicable law. There is no mandatory arbitration clause or waiver of class or collective remedies. 13. App stores and other terms

Apple's or Google's applicable store terms govern their distribution, payment and account services. On Apple platforms, Apple's standard end-user licence agreement applies unless a valid custom licence is supplied through the store; these game-service terms do not purport to replace it. Store rules do not reduce non-excludable consumer rights.

These Terms and the Privacy Policy remain readable offline in Settings. Future-feature clauses apply only to features actually offered and do not mean that purchases or optional analytics are already active.
