Welcome to Milky Cat! These Terms of Use ("Terms") govern your use of our mobile game ("Game") developed by Persoftware SRL ("we", "us", "our"). By downloading, installing, accessing, or using the Game, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Game.
These Terms incorporate our Privacy Policy. On Apple platforms, these Terms supplement the Apple Standard End User License Agreement; the Apple agreement controls where it is required to do so.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Game for your personal, non-commercial use on a mobile device owned or controlled by you. All rights not expressly granted to you are reserved by us.
Milky Cat is designed for a mixed audience. On first launch, the Game asks for a broad age category, including an option not to declare one, so that age-appropriate privacy and advertising protections can be applied. We do not ask for a birth date.
If you are not old enough to accept these Terms under the law where you live, a parent or legal guardian must review and accept them for you. The core Game remains available when a player is classified as Child or Unknown; optional online, social, analytics, messaging, and advertising services are restricted as described in the Privacy Policy.
Do not submit personal information through support or feedback features without parent or guardian involvement where local law requires it. If we learn that personal information from a child was processed contrary to our Privacy Policy, we will investigate and delete it as appropriate.
The Game may offer consumable virtual currency or items, non-consumable entitlements, and auto-renewing subscriptions (collectively, "Purchases"). Virtual goods are licensed for use only within the Game and cannot be exchanged for money or transferred outside the Game.
Any subscription name, benefits, billing period, and localized price are displayed in the purchase screen before confirmation. Monthly plans renew each month and annual plans renew each year until canceled. Payment is charged to your Google Play or Apple account. You can manage or cancel a subscription from the Game's Manage Subscriptions entry point or through your store account; uninstalling the Game does not cancel a subscription. Cancellation normally takes effect after the current paid period, subject to the store's rules and applicable law.
Purchases and refunds are processed by Google Play or Apple under their applicable terms and refund rules. Nothing in these Terms limits any mandatory consumer rights or refund rights provided by applicable law.
The Game may include multiplayer features that allow you to interact with other players. In multiplayer mode, players can attack regions owned by others and engage in time-based duels. You are responsible for your interactions with other players. We are not responsible for the conduct of any players and do not endorse any opinions expressed by players. We reserve the right, but have no obligation, to monitor disputes between you and other players.
The Game may show advertisements only to Adult sessions through Appodeal and its authorized advertising partners, subject to the consent and platform choices described in the Privacy Policy. Child, Unknown, and Teen sessions are not shown advertisements. The Game may offer a purchase or subscription that removes interruptive advertising while its entitlement remains active.
For eligible Teen and Adult sessions, the Game may connect to Google Play Games or Apple Game Center to provide achievements, leaderboards, identity, and related social features. These platform services are not initialized for Child or Unknown sessions. Your use of Google Play Games and Apple Game Center remains subject to their respective terms and privacy policies.
You agree not to engage in any of the following prohibited activities:
All content, features, and functionality of the Game, including but not limited to text, graphics, logos, images, audio, and software, are owned by us or our licensors and are protected by intellectual property laws. You may not use any content from the Game without our prior written permission.
We may terminate or suspend your access to the Game, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Game will immediately cease.
The game is provided 'as is' and 'as available,' without any warranties, either express or implied, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee that the game will be uninterrupted, error-free, or that any defects will be corrected. We also do not guarantee that the game will be compatible with all devices or operating systems. The use of the game is subject to the availability of third-party services such as Google Play Games and Apple Game Center, whose functionality and terms may affect your gameplay experience.
We do not guarantee that the game is or will be free of viruses, malware, or other harmful components. You are responsible for implementing adequate security measures on your device to protect against such risks.
By using this game, you agree that your use of the game is at your sole risk. To the fullest extent permitted by law, we disclaim all implied warranties, including those of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Game after any such changes constitutes your acceptance of the new Terms.
These Terms shall be governed and construed in accordance with the laws of Romania, without regard to its conflict of law principles, except where otherwise required by mandatory local laws. By using the Game, you agree that any legal disputes arising out of or related to these Terms or the Game will be subject to the jurisdiction of the courts located in Romania.
If you are accessing the Game from outside Romania, you are responsible for ensuring that your use of the Game complies with the laws of your jurisdiction. To the extent permitted by applicable law, users from other countries agree to waive any rights to pursue claims under laws of their home country and submit to the laws of Romania as governing these Terms. However, where local laws provide stronger consumer protections, those protections will apply in addition to these Terms.
